Terms of Use

Welcome to Nyra, developed and published by Nexdev ("Company," "we," "us," or "our"). These Terms of Use constitute a legally binding agreement between you ("you," "User") and Nexdev regarding your access to and use of the Nyra mobile applications, website (https://nyra.nexdev.codes), and associated AI cloud services (collectively, the "Nyra Service").

By downloading, installing, registering for, or using the Nyra Service, you signify that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms in their entirety, you must immediately uninstall and discontinue using Nyra.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Nyra Service. By accessing Nyra, you represent and warrant that you possess the full legal capacity to enter into these Terms and comply with all applicable local, national, and international laws and regulations.

Nyra provides camera-assisted crystal and mineral identification, chakra guides, metaphysical lore, moon phase rituals, and digital collection management. Specific app features may be subject to additional posted guidelines, all of which are incorporated by reference into these Terms.

Your privacy is of utmost importance to us. Please review our Privacy Policy to understand how we collect, use, and protect your information when using the Nyra Service.

Nexdev reserves the right to modify or replace these Terms at any time. When material modifications occur, we will post the updated version on our website and update the "Last Updated" timestamp. Your continued use of the Nyra Service following any changes constitutes your irrevocable acceptance of the revised Terms.

Subject to your full compliance with these Terms, Nexdev grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable limited license to download, install, and use the Nyra application on compatible mobile devices that you own or control for personal, non-commercial use.

The visual interfaces, UI elements, graphics, neural model weights, crystal database entries, software code, audio, and all other proprietary elements of the Nyra Service are protected by copyright, trademark, trade secret, and international intellectual property laws. All rights not expressly granted herein are reserved by Nexdev.

You expressly agree that you will not:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code or neural network models of Nyra.
• Scrape, crawl, harvest, or extract data from the Nyra crystal database via automated bots or scripts.
• Rent, lease, lend, sell, redistribute, or sublicense the Nyra Service or any of its features.
• Attempt to circumvent security tokens, rate limits, or payment mechanisms.
• Use Nyra to conduct unlawful activities or infringe third-party rights.

You retain ownership of the photos, notes, and collection logs you submit to Nyra. By uploading images or notes to the Nyra Service, you grant Nexdev a worldwide, royalty-free license to host, process, and analyze such content solely to provide, refine, and maintain the identification services for your account.

Nyra supports anonymous guest access as well as authenticated accounts via Apple Sign-In and Google Sign-In. You are solely responsible for all activities that occur under your account credentials and for maintaining the confidentiality of your session tokens.

Nexdev reserves the right to suspend or terminate your account access at our sole discretion, without prior notice, if we detect fraudulent activity, security breaches, or violations of these Terms.

You consent to receive service communications electronically, either via in-app notifications or through the email address linked to your account. Electronic notices satisfy any legal requirement that such communications be in writing.

If you submit feedback, suggestions, or bug reports to Nexdev, you grant us an unrestricted, irrevocable, perpetual, royalty-free right to use, incorporate, and implement such suggestions without any compensation or obligation to you.

The Nyra Service integrates with third-party platforms, including Apple App Store, Google Play Store, and RevenueCat. Your transactions and interactions with these third parties are subject to their respective terms and privacy policies.

THE NYRA SERVICE AND ALL CRYSTAL IDENTIFICATION DATA, METAPHYSICAL DESCRIPTIONS, AND CHAKRA INFORMATION ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

NEXDEV DOES NOT GUARANTEE 100% IDENTIFICATION ACCURACY UNDER ALL CIRCUMSTANCES (LIGHTING, RESOLUTION, RARE VARIANTS). CRYSTAL HEALING PROPERTIES AND CHAKRA ENERGIES ARE ROOTED IN HISTORICAL TRADITIONS AND METAPHYSICAL BELIEFS AND MUST NEVER BE USED AS A SUBSTITUTE FOR LICENSED MEDICAL, PSYCHOLOGICAL, OR FINANCIAL DIAGNOSIS OR TREATMENT.

You agree to indemnify, defend, and hold harmless Nexdev, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use or misuse of the Nyra Service or violation of these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NEXDEV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE NYRA SERVICE. NEXDEV'S TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNT YOU PAID TO NEXDEV IN THE PRECEDING TWELVE MONTHS.

Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved through confidential, binding arbitration on an individual basis, rather than in court. You and Nexdev waive any right to participate in class action lawsuits or class-wide arbitration.

These Terms are governed by and construed in accordance with the laws applicable to Nexdev operations, without giving effect to any conflict of law principles. If any provision of these Terms is found unlawful or unenforceable, that provision shall be deemed severable and shall not affect the validity of remaining provisions.

If you downloaded Nyra from the Apple App Store, the following terms apply:

• These Terms are concluded solely between you and Nexdev, not with Apple Inc. Nexdev is solely responsible for the Nyra application and content.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Nyra.
• In the event of any failure of Nyra to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you (if applicable); to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
• Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

Nexdev respects the intellectual property of others. If you believe your copyrighted work has been infringed by content within Nyra, please submit a written DMCA notice to our designated agent at support@nexdev.codes containing all statutory requirements.
